The passing of a loved one is never easy on a family. Hero, Jorstad & Jacobsen Law Firm, P.A. assists families by explaining the legal process and working with the personal representative to probate the deceased’s estate.

Probate is the legal process of settling a person’s financial affairs after his or her death.

The property titled to decedent is located, collected, and inventoried, notice is given to the decedent’s creditors, valid debts and taxes are paid, and the remainder is distributed to the person’s heirs if he or she did not have a will (intestate), or to the people provided for if the person died with a will (testate). A personal representative is appointed to complete the above mentioned tasks. Certain types of property such as joint tenancy property, jointly held bank accounts, payable-on-death accounts, and life insurance policies that name a beneficiary can be transferred without going through probate.
